Due to the Allocation Ordinance of the Senate Department for Justice of May 8, 2008 (ZuwV) and other legal regulations, the Berlin district courts have the following special responsibilities:
District Court of Charlottenburg
The district court of Charlottenburg is in the state of Berlin gem. §§ 4-8 ZuwV responsible for:
– District court decisions in civil inland waterway matters
– Keeping the commercial, inland waterway, seagoing and shipbuilding registers, the partnership and property rights registers
– the tasks of the district court in association matters
– District court decisions in legal disputes in the area of naming rights, publishing rights and copyright
– for insolvency proceedings – with the exception of consumer insolvency proceedings and other small-scale proceedings in accordance with the ninth part of the Insolvency Code, which are applied for by the debtor himself (for these, each local court is responsible for its judicial district)
District Court of Köpenick
The district court of Köpenick is in the state of Berlin acc. § 15 ZuwV responsible for his district for decisions of the district court in all family matters according to § 111 FamFG .
District Court of Mitte
The district court Mitte is in the state of Berlin acc. § 16 ZuwV responsible for decisions of the district court in civil traffic matters. According to § 16 para. 2 ZuwV:
– Claims arising from a traffic accident resulting from the operation of a vehicle, which
are not exclusively based on a violation of the duty to ensure public safety, even if they are asserted against the insurer under contract or statutory provisions.
– Claims by the insurer, which this in the course of recourse due to injury to the insured
when participating in road traffic or as a result of the traffic accident.
– Claims of the insured for insurance cover from a traffic accident if the insurer announces recourse for these reasons.
District Court of Pankow
The District Court District Court of Pankow is in the state of Berlin acc. § 15 ZuwV for his district as well as for the districts of the district courts Mitte, Wedding and Tiergarten responsible for decisions of the district court in all family matters according to § 111 FamFG .
Furthermore, the District Court of Pankow/Weißensee according to §§ 10-12 of the International Family Procedures Act
– responsible for the recognition and enforcement of the decisions from the Hague Child Protection Convention and the European Custody Convention listed there, unless another place of jurisdiction is given
– Responsible for proceedings under the Hague Child Abduction Convention in the State of Berlin.
District Court of Schöneberg
The district court of Schöneberg is in the state of Berlin acc. §§ 9-15 ZuwV responsible for:
– Decisions of the district court in all family matters for its district according to § 111 FamFG
– Domestic requests for legal and administrative assistance, with the exception of requests relating to guardianship and probate matters
– Requests for legal and administrative assistance from abroad in civil or commercial matters, with the exception of requests for service
– District court decisions on applications for a declaration of enforceability of foreign debt instruments in civil and commercial matters
– District court decisions on applications to set aside or amend the declaration of enforceability and the declaration of enforceability of decisions relating to child maintenance claims in one of the Contracting States to the Hague Convention of 15 April 1958 on the Recognition and Enforcement of Decisions Regarding Child Maintenance Obligations (Articles 1, 4 to 8, 12 of the Convention)
– the processing of requests for legal assistance and for decisions of the district court on applications for a declaration of enforceability of foreign debt instruments under Sections 2 and 4 of the Act on the Implementation of the Hague Convention of March 1, 1954 on Civil Procedure
– Decisions of the district court in agricultural matters according to § 1 of the law on the judicial
proceedings in agricultural matters
– Decisions of the district court according to Sections 48 and 49 of the Personal Status Act
– District court decisions in proceedings under the first and second sections of the Transsexuals Act
Furthermore, the district courtof Schöneberg according to
– § 15 ZPO Jurisdiction of extraterritorial Germans
– § 122 FamFG responsible for matrimonial matters, unless another place of jurisdiction is given
– § 170 FamFG responsible for parentage matters, unless another place of jurisdiction is given
– § 187 FamFG responsible for adoption matters, unless another place of jurisdiction is given
– § 218 FamFG responsible for pension equalization matters, unless another place of jurisdiction is given
– § 272 FamFG responsible for care matters, unless another place of jurisdiction is given
– § 313 FamFG responsible for placement matters, unless another place of jurisdiction is given
– § 343 FamFG responsible for probate matters, unless another place of jurisdiction is given
– § 2 TSG responsible for name changes according to the Transsexual Act, provided no other place of jurisdiction is given
District Court of Kreuzberg
The district court of Kreuzberg is in the state of Berlin acc. § 15 ZuwV for all local court districts with the exception of the local court districts of Köpenick, Mitte, Pankow/Weißensee, Tiergarten, Wedding and Schöneberg responsible for decisions of the local court in all family matters according to § 111 FamFG .
District Court of Tiergarten
The district court of Tiergarten is in the state of Berlin acc. §§ 1-4 + 9 ZuwV responsible for:
– All criminal cases and fines
– District court decisions on detention, deprivation of liberty and searches under the Federal Criminal Police Office Act and the Federal Police Act
– Decisions of the district court on deprivation of liberty under the provisions of the law on foreign nationals in connection with the law on the procedure in family matters and the law on matters of voluntary jurisdiction
– Decisions in criminal inland waterway matters
– the tasks of the district court as a depository according to the deposit regulations
– Requests for legal and administrative assistance in criminal matters, with the exception of requests for service received from abroad
– Requests for legal and administrative assistance in disciplinary matters
– Requests for legal and administrative assistance from within Germany if one of the persons to be questioned is in prison in one of the Berlin prisons
